Petitioner seeks bail in connection Madanpur P.S. Case no. 284 of 2020 registered for the offence punishable under sections 30(a) ( C ) of Bihar Prohibition and Excise Amendment Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2020, he is person with clean antecedent and charge sheet has been submitted. He next submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that 140 liter country made liquor was recovered and said liquor does not belong to the petitioner. Learned APP vehemently opposed the prayer for bail.

No.24209 of 2021(2) dt.17-11-2021 2/2 Considering the facts that petitioner is in jail custody since 24.12.2020 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge (Excise), Aurangabad in Madanpur P.S. Case no. 284 of 2020.
