2. The petitioner, who is in custody since 29.10.2024, seeks regular bail in connection with Town P.S. Case No. 669 of 2024 registered for the offence under Sections 108, 84, 352, 79 & 3(5) of the Bharatiya Nyaya Sanhita, 2023. Later on Section 103(1), 61(2), 238(A), 3(5) of the BNS was added.
3. As per the FIR, the informant who is the wife of the deceased has said that on account of having been tortured by the father-in-law (petitioner) and her brother-in-law namely Deepak
Patna High Court CR. MISC. No.13881 of 2025(3) dt.09-05-2025 2/3 Choudhary, she was ousted from her matrimonial house as a result of which, she was staying at her father's place. On 28.10.2024, she was informed that her husband had been killed by setting him ablaze by her father-in-law and her brother-inlaw.
4. Learned Senior counsel for the petitioner has submitted that the petitioner is innocent and has not committed any crime. The petitioner has falsely been implicated in this case. He further submits that the deceased set himself on fire as a result of which the deceased died.
5. Learned counsel for the informant has vehemently opposed the prayer for bail of the petitioner and has submitted that from the post-mortem report, it will appear that the deceased was killed by pressing his neck and thereafter the dead body was burnt to give a color of suicide.
6. I have heard and considered the submissions of the parties.
7. It is the petitioner, his son namely, Deepak Choudhary and the deceased who were in the house. The deceased has been killed in the house.
8. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner though he is the

9. Accordingly, this application for regular bail is hereby rejected.
