No one appears for the State.

The petitioner in the present case is seeking regular bail in connection with Shyampur Bhatha P.S. Case No. 01 of 2017, registered for offences alleged under Section 414 of the Indian Penal Code read with Sections 25(1-b)A, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that a bare perusal of the F.I.R. would show that the allegation against this petitioner is that he fled away on seeing the police party when the motorcycle on which he was a pillion rider was intercepted by police. In the First Information Report it is alleged that one Golu Kumar was arrested and from his possession one country-made

Patna High Court Cr.Misc. No.32337 of 2017 (2) dt.20-07-2017 2/2 pistol with live cartridges and stolen motorcycle were recovered. It is he who disclosed the name of this petitioner. Learned counsel submits that the petitioner has no criminal antecedent and there is no recovery from his possession. He is in custody since 20.03.2017.

In the facts and circumstances, let the petitioner, namely, Ravi Kumar @ Prakash be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sushil Prasad, learned Judicial Magistrate 1st Class, Sheohar, in connection with Shyampur Bhatha P.S. Case No. 01 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
