Petitioner seeks bail in a case registered under Sections 302/34 of Indian Penal Code and Section 27 of Arms Act.

It is submitted by the petitioner's counsel that other than Maner Police Station Case No 357 of 2017 in which the petitioner is on bail, there is no other criminal antecedent of the petitioner. It is further submitted that the petitioner's name has been put in the column of the accused persons in the instant case though the first information report does not disclose any allegation against him. it is also submitted that other co-accused, against whom there is no allegation in the FIR, have been allowed bail by

Patna High Court Cr.Misc. No.13536 of 2018 (3) dt.12-04-2018 2/2 this Court in the various orders passed in Cr Misc No 5198 of 2018, Cr Misc No 58555 of 2017 and Cr Misc No 10877 of 2018. Petitioner is in custody in connection with this case since 18.08.2017.

Considering the aforesaid submissions, petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Danapur, Patna in Maner Police Station Case No 89 of 2017 d subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
