2. The petitioner makes a prayer for grant of regular bail in connection with Ballia P.S.Case No. 303 of 2024 registered under sections 303(2) of the BNS
3. It appears from the perusal of the first information report that the motorcycle which was being used by the informant went missing, while he had gone for his daily work and the allegation is against unknown for having committed theft of the motorcycle and hence the FIR has been lodged against unknown.
4. However, the seizure list has been put up on record which shows that the said recovery of Apatche Motorcycle was made from possession of the co-accused Aditya Kumar and the
Patna High Court CR. MISC. No.14186 of 2025(2) dt.19-03-2025 2/2 name of the petitioner, as would appear from perusal of the order of the court below rejecting bail, appears in the confessional statement of the co-accused, Aditya Kumar. It is taken into consideration that there is no criminal antecedent against the petitioner and is languishing in custody since 28.10.2024.
5. Considering the aforesaid facts and circumstances of the case, the petitioner is enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S.Case No.303 of 2024.
