JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2017 The petitioners seek regular bail in connection with Ara Nawada P.S. Case No. 113 of 2017, registered for offences punishable under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant.

It has been submitted on behalf of the petitioners that allegation of assault on the informant by means of iron rod has been levelled against three persons, however, only two injuries were found on the person of the informant and there is nothing available on record to show that who assaulted the informant

causing injury on his head. Further they have been in custody since 27.03.2017 and now charge-sheet has also been submitted. Learned counsel for the State as well as learned counsel for the informant has opposed the prayer for bail and submitted that injury report has still not been brought on record. Having heard both sides, considering the fact that allegation of assault against three persons and only two injuries were found on the person of the informant and also petitioners have no criminal antecedents and has been in judicial custody since 27.03.2017, as such, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, Bhojpur, in connection with Ara Nawada P.S. Case No. 113 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the

disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of their bail bonds.
