JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in connection with Amdabad P.S.Case no.123 of 2015 registered under Sections 25(1b)A/26 of Arms Act, pending in the court of learned C.J.M., Katihar.

As per prosecution, four country made pistols and 35 live cartridges were recovered from the possession of the petitioner.

It is submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in the case. It is further submitted that there is no recovery from the conscious possession of the petitioner. He is in jail since 16.02.2017.

Considering the fact that four country made pistols and

Patna High Court Cr.Misc. No.31058 of 2017 (2) dt.06-07-2017 2/2 35 live cartridges were recovered from the possession of the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, the trial court is directed to conclude the trial within a period of six months from the date of receipt/production of a copy of this order.
