2. This is the first regular bail application of the petitioners seeking his regular bail in connection with Atri P.S. Case No.138 of 2024, registered for the offence under Sections 341, 323, 427, 379, 307 and 304 of the I.P.C. and Section 27 of the Arms Act.

3. According to the case of prosecution, a written complaint has been filed by one Abhishek Kumar alleging therein that on 22.04.2024 at about 8:34 p.m. all the present applicants alongwith the other five other co-accused persons and

There broken the glasses of the vehicles as a result of which total Rs. 40,000/- loss was caused. It is further alleged that on the protest by the employee Praveen Kumar has been assaulted by the accused persons with the help of stick and iron rod and they also fired. On the basis of said written complaint made by the informant, the offense has been registered.

4. It is submitted by the learned counsel for the petitioners that petitioners are innocent and have falsely been implicated in the present case due to some dispute with the informant. He further submits that though there are five criminal antecedents against the present applicants, as of now, both the parties have already settled their dispute out of court. All the accused persons herein are in custody 18.10.2024 and chargesheet has been filed. Therefore, on these grounds, it is prayed that the petitioners may be granted benefit of bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioners.

Considering the submissions made by the counsel for the petitioner and the fact that the injured Praveen Kumar sustained only simple injury on his body and further considering the fact that both the parties settled their matter outside the Court, I am of the view that it is a case where the petitioners should be granted benefit of bail.

9. Accordingly, the application is allowed.

10. The petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Atri P.S. Case No.138 of 2024.
