The petitioner is apprehending his arrest in connection with Madanpur P.S. Case No. 12 of 2016 for the offences instituted under Sections 406, 409 and 420 of the IPC. The prosecution story, in brief, is that on 30.01.2016, on information received by the informant that the Chairman in 'Vyapar Mandal Committee Bhawan' is used to purchase paddy from intermediaries, he reached there and found paddy kept in Jut Boras, are unloaded from the pick-up Van. He made enquiry there from the persons present but none come forward to claim said paddy. On search, it was found that the Chairman, few time before

No.11163 of 2016 (2) dt.25-04-2016 2/3 he had gone after purchasing paddy and on query from one Jitendra Yadav purchasing said paddy, he told that the Chairman had directed him to unload and kept the paddy on the pick-up Van. It is alleged that the Chairman is purchasing paddy from intermediaries and in presence of Villagers 34 Boaras of Paddy loaded on the said vehicle has been seized. So, it is alleged that this petitioner being Chairman of the said Vyapar Mandal entrusted to purchase paddy from Data Base farmers has purchased the paddy from intermediaries violating the said direction.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has been made accused in the present case due to mistake of fact. The alleged 34 bags of paddy has already been released in favour of Shatrudhan Singh who is a farmer. The petitioner is the Chairman of PACS. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Madanpur P.S. Case No. 12/2016 on furnishing bail bond of Rs. 10,000/-(Ten
