JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A,504 and 506/34 of the Indian Penal Code.

The accusation is of abducting the minor daughter of the informant. It is alleged against the petitioner that the victim left the house at 10 A.M. with the petitioner on 14.1.2015 and thereafter she went traceless when it was suspected that the son of the petitioner Basantu Rai enticed her away.

It is submitted by the learned counsel for the petitioner that the time of disappearance of the victim has been mentioned in the FIR as 10 A.M. and 4 P.M. which reflects that maliciously the

It is further submitted that for the occurrence of 24.1.2015 the written report was lodged on 6.2.2015 and the thrust of accusation is against the son of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case and the thrust of accusation is against the son of the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur in connection with Karamchat P.S. Case No. 5 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
