JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Karjain P.S. Case No. 57 of 2014 for the offences instituted under Sections 447, 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code and Section 3(i)(x) of the SC/ST Act. As per prosecution case, it is alleged by the informant that on 25.08.2014 at about 12.50 hours in day, all the accused persons came in the Ajanta Computer and Mobile shop situated at Ghoshpur Road and started assaulting by calling caste name and further alleged that four mobiles worth Rs.4,000/- snatched by the accused persons.
Patna High Court Cr.Misc. No.11281 of 2016 (2) dt.25-04-2016 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. In course of investigation, no offence under Section 307 of the IPC was found to be true. No offence under Section SC/ST Act is attracted against the petitioners.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Karjain P.S. Case No. 57 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Birpur, within DistrictSupaul, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
