Petitioner, already in custody, seeks bail in connection with complaint case of Excise Department, Sitamarhi Case No.C2/733/2017, registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that 120 liters of Nepali liquor was recovered from possession of three accused.

Learned counsel for the petitioner submits that petitioner is apprehended on suspicion, he is in custody since 25.12.2017, the petitioner has clean antecedent and other two co-accused, similarly situated, have been admitted to bail by a coordinate Bench of this Court.

No.4804 of 2018(2) dt.31-01-2018 2/2 Having considered the said facts and circumstances, petitioner Irshad Khan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with complaint case of Excise Department, Sitamarhi Case No.C-2/733/2017.
