The petitioner is in custody in connection with Phenhara P.S.Case No.76 of 2013 registered for an offence under Sections 302/34 of the IPC.
It has been submitted that the aforesaid Phenhara P.S.Case No.76 of 2013 was lodged by the informant against six accused persons named in the FIR. After investigation, the police exonerated the FIR named accused and submitted chargesheet against this petitioner for the offence under Section 306 of the IPC.
On perusal of the impugned order, it appears that the husband of the petitioner was in jail and some of the associate of her husband used to visit the place of petitioner which was being
Patna High Court Cr.Misc. No.43671 of 2017 (2) dt.19-09-2017 2/2 objected by her son. It has been further alleged that the son of the petitioner seeing the conduct of his mother committed suicide. There is no specific allegation against the petitioner and she is in custody since 22.04.2017.
Considering the omnibus allegation of abetment facts and circumstances, prayer is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-12, Motihari, East Champaran in connection with Phenhara P.S.Case No.76 of 2013.
