JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 29-09-2015 The petitioner prays for quashing of the order dated 8.9.2014, passed by respondent no.3 by which his show cause filed on 29.8.2014 has been rejected, treating his Hawker licence cancelled.

The petitioner submits that he is not being allotted Kerosene oil. However, in view of order dated 23.3.2012, passed in CWJN No. 2497 of 2007, his PDS licence has been restored.

I find that no final order has been passed regarding cancellation of petitioner's licence. As such, respondent no.3 should pass appropriate order clarifying the position whether petitioner's PDS licence has been cancelled or not

Patna High Court CWJC No.5683 of 2015 (3) dt.29-09-2015 after taking into account the show cause filed by him, preferably within three months from the date of receipt of this order.
