JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 302,328 and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant by administering poison.
It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner who is married sister of the husband of the victim. The impugned order reflects that charge sheet has been submitted under sections 302,328 and 201/34 IPC declaring the petitioner as absconder. This court is not inclined to entertain the present anticipatory bail application. However, let the learned court below
Patna High Court Cr.Misc. No.17420 of 2015 (2) dt.13-05-2015 2/2 consider the prayer for regular bail of the petitioner keeping in view the fact that investigation has already concluded, in case the petitioner surrenders within six weeks from today in connection with Bihariganj P.S. Case No. 1575 of 2014 pending in the court of learned A.C.J.M., Madhepura.
Needless to say, there is no need of custodial interrogation of the petitioner who is lady.
This application is disposed of with the aforesaid observation/direction.
