This is an application for bail in connection with Amas P.S. Case No. 26 of 2014, registered for the offences punishable under Sections 147, 148, 149, 307, 302, 353, 345, 332, 395, 120B, 121A, 124A of the Indian Penal Code, 27 of the Arms Act and 17 of CLA Act.
Petitioner is named in the FIR.
Submission of learned counsel for the petitioner is that he has been made accused only on the basis of suspicion and nothing has been recovered from his possession. Further submission is that petitioner is a handicapped person and at the instance of police he has been made accused in this case.
Heard learned APP also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.43699 of 2017 (4) dt.06-11-2017 2/2 Having heard both sides and in view of facts and circumstances, as stated above, and also considering the fact that he is accused in 12 other cases, I am not inclined to grant bail to the petitioner.
However, learned trial court is directed to expedite the trial of the petitioner.
