JUSTICE ASHWANI KUMAR SINGH) 04-09-2021 Mr. Amish Kumar, learned counsel for the petitioner submitted that though the present application has been filed for issuance of a writ, in the nature of habeas corpus, during pendency of the application the victim daughter of the petitioner has been recovered and has made her statements under Sections 161 and 164 of Criminal Procedure Code.
Learned counsel for the State submitted that in her
Patna High Court CR. WJC No.315 of 2020(2) dt.04-09-2021 2/2 statement, the victim made it clear that she fell in love with the FIR named accused Jamshed and when her parents came to know about her affair with the accused, they took her to task. She, therefore, out of her own choice, married Jamshed and went to Nepal and started living with him as husband and wife. Be it as it may, in view of the submissions made at the Bar, the instant application in the nature of habeas corpus has become infructuous. It is dismissed, accordingly.
