The petitioners are seeking anticipatory bail in connection with Pupri P.S. Case No. 516 of 2018 registered under Sections 341, 342, 323, 353, 427, 504, 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that as per the first information report when the informant, who was Observer in the meeting of the General Assembly, was holding meeting, the petitioners along with 4 - 5 accused accused persons started making allegation against ward Punch and another applicant namely, Anita Devi. It is alleged that in the

No.16703 of 2019(2) dt.28-03-2019 2/3 meeting they obstructed people to sign on the proceeding register and abused ward Punch Anita Devi, tore the General Assembly register into pieces and attempted to issue selection letter after keeping ward punches and thereby used force to deter the informant for discharge of public duty. Learned counsel submits that allegations are false and flimsy allegation. It is submitted that the case has been registered because the petitioner had raised objection to the selection process in which the Observer wanted to select the applicant Anita Devi but due to protest of the beneficiaries she could not succeed in her illegal act. Learned counsel submits that the whole allegations are baseless and it is a case of malafide prosecution.

Learned A.P.P. is present and has opposed the prayer for anticipatory bail of the petitioners.

Considering the facts and circumstances of the case wherein it appears that some dispute and differences arose between the parties in course of meeting over selection of a candidate and that there is no allegation of assault against the informant as also that the petitioners have not no criminal antecedent, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named

No.16703 of 2019(2) dt.28-03-2019 3/3 petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Pupri P.S. Case No. 516 of 2018, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
