This application has been filed for restoration of Cr. Misc. No. 50921 of 2019, which stood dismissed due to noncompliance of peremptory order, dated 04.11.2019, whereunder the petitioner was directed to take steps for fresh service of notice upon opposite party no. 2 by both processes, under ordinary post as well as under registered cover with A/D, on her correct and present address, within four weeks. Submission is that due to unavoidable circumstances, the peremptory order, dated 04.11.2019, could not be complied, but, later on the same has been complied with by the petitioner on 08.01.2020 by filing the requisites.
