Petitioner, already in custody, seeks bail in connection with Jagdishpur (Goradih) PS Case No.258 of 2017, registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that due to land dispute, the accused persons came in the night while the informant and her husband were sleeping and Natukwa Mahto shot at the husband of the informant causing his death.

Learned counsel for the petitioner submits that petitioner has falsely been implicated due to land dispute and as per FIR itself the specific allegation of killing the deceased is

Patna High Court Cr.Misc. No.23147 of 2018(2) dt.19-04-2018 2/2 against Natukwa Mahto and not against this petitioner and has no criminal antecedent except one case of theft. Having considered the aforesaid facts and circumstances, petitioner Fuko Mahto @ Fuko Mandal @ Raju @ Parmanand Bind @ Parmanand Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Jagdishpur (Goradih) PS Case No.258 of 2017.
