JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-05-2024 The present petition has been filed for modifying the order dated 19.08.2023 passed in Criminal Misc. No. 52096 of 2023 to the extent that the time granted to the petitioner herein (petitioner no. 2 in Criminal Misc. No. 52096 of 2023), to surrender before the learned Court below, for being granted anticipatory bail, be extended by a further period of six weeks from today.

The learned counsel for the petitioner submits that on account of the aforesaid order dated 19.08.2023 being not communicated to the petitioner herein in time on account of the

No.29151 of 2024(2) dt.03-05-2024 2/3 petitioner being employed outside the State of Bihar, the petitioner herein could not surrender within the stipulated time, however, a sympathetic view be taken and the time granted to the petitioner to surrender before the learned court below, be extended by a further period of six weeks from today.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to modify the aforesaid order dated 19.08.2023 passed in Criminal Misc. No. 52096 of 2023 qua the petitioner herein, by extending the time granted to him to surrender before the learned court of C.J.M., Bhojpur at Ara in connection with Barhara P.S. Case No. 317 of 2023, by a further period of six weeks from today.

Rest of the order dated 19.08.2023 passed in Criminal Misc. No. 52096 of 2023, shall remain as it is.

Accordingly, the present petition stands disposed off with the aforesaid modification in the order dated 19.08.2023 passed in Criminal Misc. No. 52096 of 2023.
