Petitioner is languishing in judicial custody since 28.02.2017 in connection with Udwantnagar P.S. Case No. 41/2017 for offences punishable under Sections 379, 411 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that he was sleeping in his house parking his motorcycle outside. In the night he heard some sound and on waking up he saw three persons on two motorcycles trying to take away his motorcycle. Petitioner along with other three co-accused was apprehended by the local people on the spot.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.35492 of 2017 (2) dt.17-08-2017 2/2 petitioner that for the same offence a case under the Arms Act was also registered bearing Udwantnagar P.S. Case No. 40/17 and except that the petitioner has no other criminal antecedent. He submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Udwantnagar P.S. Case No. 41/2017.
