The petitioner seeks bail in a case for the offences punishable under sections 366 (A) and 376/34 of the I.P.C. Allegedly the petitioner and co-accused Sustanand Rai committed rape with the informant and after causing threats directed to keep mum.

Submission is of false implication and that to extract money this case has been lodged. The petitioner has got no criminal antecedent and is suffering in custody since 02.04.2014 to which the learned A.P.P. opposes.

Considering the submissions and noticing the allegation attributed against the petitioner which finds support

Patna High Court Cr.Misc. No.27441 of 2014 (3) dt.16-02-2015 2/2 during the statement recorded under section 164 Cr.P.C also this Court is not inclined to release the petitioner on bail. Accordingly, his prayer for bail stands rejected in connection with Balrampur P.S. Case No. 149 of 2013/ G.R. No. 3864 of 2013 pending in the Court of Additional District & Sessions Judge-I, Cum- Special Judge, Katihar.
