Petitioner, already in custody, seeks bail in connection with Dighalbank PS Case No.68 of 2017, registered under Sections 147, 149, 353, 341, 323, 324, 364, 379 and 504 of the Indian Penal Code.
Allegation in brief is that the accused persons were entering into the Indian border from Nepal with some cattle and engaged in illegal trade of bringing cattle from Nepal to India. The case was instituted by the Border Security Force and 22 persons were named.
Learned counsel for the petitioner submits that the petitioner is resident of the village situated on the border of India and Nepal, there is allegation of assault to the Constables
Patna High Court Cr.Misc. No.23753 of 2018(2) dt.20-04-2018 2/2 of Border Security Force but there is no injury to anyone and seeks bail of the petitioner on the ground of parity as other coaccused Abdul Rakim and others have been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No.52093 of 2017 on 15.11.2017.
Having considered the aforesaid facts and circumstances, petitioner Mustafa is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Kishanganj in connection with Dighalbank PS Case No.68 of 2017.
