====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Buxar Rail P.S. No. 13 of 2017 dated 6.2.2017, registered for the offence punishable under Sections 3/4 of the Explosive Substance Act.
The allegation of the prosecution is that some unknown accused persons had exploded bomb near the railway track, however, no damage was caused either to the train or the railway track.
The learned counsel for the petitioner submits that the petitioner has a clean antecedent, the F.I.R. has been lodged against unknown persons and the petitioner has been falsely implicated in the case on account of village rivalry by the
Patna High Court Cr.Misc. No.33626 of 2017 (2) dt.20-07-2017 2/2 villagers. It is further submitted that the petitioner is languishing in jail since 20.03.2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Rail, Bhojpur at Ara in connection with Buxar Rail P.S. Case No. 13 of 2017.
