2. The petitioner seeks bail in connection with Chakmehsi P.S. Case No.233 of 2023 instituted for the offences under Sections 379, 414, 467, 468 and 471 of the Indian Penal Code.

3. Prosecution case, in short, is that informant during course of patrolling police arrested one bike rider without helmet and after interrogation the petitioner's name was transpired as Prem Prakash Mani. After that the police demanded documents in which it was found that the motorcycle was in the name of Pramod Kumar Sahni and there is difference

Patna High Court CR. MISC. No.18605 of 2024(2) dt.21-03-2024 2/3 in chassis number and engine number was deleted and also on interrogation it was found that vehicle is stolen one. Accordingly, the FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Further submits that petitioner is working as Junior Engineer in TTB Tooling Pune and to celebrate Diwali and Chhath Pooja petitioner has come to his village. It is next submitted that petitioner has no knowledge about the motorcycle that the motorcycle is stolen one and from that motorcycle the petitioner's relatives come to his house and petitioner used the said motorcycle in question for marketing purpose. The petitioner is in custody since 17.12.2023.

5. Learned APP for the State has vehemently opposes the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of court
