JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 382/34 of the Indian Penal Code.
It is alleged that the informant had seen three FIR named accused persons including the petitioner taking out mobile phone from the pocket of an autorickshaw driver who was sleeping and some money kept in his bag. When the informant made protest then the FIR named accused persons including the petitioner gave threatening to the informant. It is submitted by the learned counsel for the petitioner that there is no recovery from the petitioner and the accusation has been levelled due to dispute with regard to wages. Patna High Court Cr.Misc. No.12813 of 2016 (2) dt.29-03-2016 2/2 bail vide Cr. Misc. No. 5374 of 2016.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Kotwali (Barari) P.S. Case No.707 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
