Mr. Mishra, the learned Advocate for the petitioners seeks permission to withdraw the application with respect to petitioner No. 2, namely, Vinay Kumar @ Binay

Patna High Court CR. MISC. No.24082 of 2021(2) dt.24-05-2022 2/3 Prasad as he has been arrested during the pendency of this bail application.

Permission is granted.

The application with respect to petitioner No. 2 is dismissed as having become infructuous.

The petitioner No. 1, namely, Raju Prashad @ Raju Prasad, seeks bail in anticipation of his arrest in connection with Yogapatti (Sanichari) P.S. Case No. 329 of 2020, dated 08.08.2020, instituted for the offences under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code. It has been submitted on behalf of petitioner No. 1 that though he is said to have assaulted the informant by means of a farsa, but the injuries received by him have been reported to be simple in nature and caused by hard and blunt substance.

Apart from this, it has been submitted that in the counter case, persons from the side of the prosecution have been granted anticipatory bail.

Regard being had to the facts afore-stated, the petitioner No. 1, namely, Raju Prashad @ Raju Prasad, in

No.24082 of 2021(2) dt.24-05-2022 3/3 the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Yogapatti (Sanichari) P.S. Case No. 329 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
