Petitioner, already in custody, seeks bail in connection with Chakiya P.S. Case No.19 of 2018, registered under Sections 379 and 420 of the Indian Penal Code. Allegation in brief is that some days back the informant was withdrawing money from the ATM and took help of one boy and he cancelled the transaction but in fact he withdrew Rs.15,000/-. Later on the informant learnt about withdrawal. After some days, the informant found two boys near the ATM and they were apprehended by the people. Learned counsel for the petitioner submits that on mere suspicion the petitioner was apprehended and no ATM card was recovered from possession of the petitioner except one
Patna High Court Cr.Misc. No.22498 of 2018(2) dt.17-04-2018 2/2 mobile and that is his personal mobile and further there is no material showing his involvement and the petitioner has clean antecedent.
Having considered the aforesaid facts and circumstances, petitioner Akhilesh Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIII, East Champaran at Motihari in connection with Chakiya P.S.
