In this case, the petitioner is seeking anticipatory bail in connection with SC/ST (Bhabua) P.S. Case No. 11 of 2016 registered for offences under sections 406, 504, 506 of the Indian Penal Code and Section 3(i) (x) of the SC/ST(POA) Act. Allegation has been made that the petitioner is running a transport business and the informant has booked his paddy in the transport of the petitioner.
Allegation has been made that the consideration amount of the paddy was not returned to the informant, save and except, Rs.10,000/-and when he has gone for demand of the
Patna High Court Cr.Misc. No.11843 of 2016 (2) dt.16-03-2016 2/2 money, he was abused and called by his caste name. It is basically a civil dispute of business, but it has been given a colour of criminal case.
Looking to the nature of allegation, in the event of the petitioner's arrest or surrender before the court below within four weeks from the date of communication of this order, let the above named petitioner be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur (Bhabua) in connection with SC/ST (Bhabua) P.S. Case No. 11 of 2016, subject to the condition as laid down under Section 438 (2) Cr. P.C.
