JUSTICE ARUN KUMAR ORAL ORDER 17-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 11.6.2017, seeks bail in Vaishali PS Case No. 151 of 2017 registered under Sections 302/34 of the IPC.

The allegation in brief is that due to dispute regarding a tree the accused persons assaulted the informant side and the allegation against the petitioner is that he gave a fasuli blow on the head of informant's brother causing his death.

Learned Counsel for the petitioner submits that there is property dispute between agnates, the petitioner is in custody since 11.6.2017 and other co-accused have been admitted to bail. Whereas learned Counsel for the State submits that there is specific allegation against this petitioner of causing death of the informant's brother.

Having considered the aforesaid facts and circumstances, the prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of one year. (Arun Kumar, J) Snkumar/- U T
