JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 06-06-2016 Heard learned counsel for the petitioner and learned counsel appearing for the State.
Petitioner apprehends his arrest in a case under sections 447, 504 and 506/34 of Indian Penal Code and under Section 3(i)(x) of the SC/ST Act.
The allegation is that petitioner along with 8 to 10 persons came to informant's house and abused him in front of villagers. The petitioner submits that the incident did not take place in public view or public place. Furthermore, he belongs to a village, which is 30 kms. away from the place of occurrence. It is unbelievable that he would come all the way to abuse the informant.
In my view, the petitioner should surrender and seek regular bail which would be disposed of on its own merit without
Patna High Court Cr.Misc. No.11573 of 2016 (3) dt.06-06-2016 2/2 prejudice, on the same day, also taking into consideration that the Petitioner has no criminal antecedent and is a resident of far off place.
With the aforesaid observation, the anticipatory bail application filed by the petitioner is hereby dismissed. (Samarendra Pratap Singh, J) kunal/- U T
