Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Piro P.S. Case No. 459 of 2021 lodged under Section 392 of the
Patna High Court CR. MISC. No.14659 of 2022(4) dt.16-08-2022 2/2 I.P.C.
As per the prosecution case, the allegation of robbery has been made in this case by 3 unknown criminals. Learned counsel for the petitioners submits that nothing was recovered from their possession, no T.I.P. has been made. Counsel further submit that their name has figured in this case on the confessional statement of Rahul Kumar. They further submits that their antecedents are clean and they are in custody since 18.12.2021. They further submits that charge sheet has already been filed in this case. Learned counsel for the State submits that from the case diary it transpires that the petitioner's antecedent is clean but the antecedents of accused Rahul Kumar is not clean. He further submits that once bail shall be granted, they shall start making delay in framing the charge.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioners at present but hereby directed to the lower court that after framing of charge they shall be release on bail to the conditions laid down by the lower court itself, so that they shall co-operate in the trial.
