Heard the learned counsel for the petitioner and learned counsel for the State.
Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Agamkuan P.S. Case No. 574 of 2021 registered for the offence under Sections 467, 468, 471, 414, 120(B) of the Indian Penal Code and Section 30(a)/41(1) of the Bihar Excise Amendment Act, 2018.
Learned counsel for the petitioner submits that the petitioner is in custody since 19.12.2022 and there is a recovery of 4878 liters of English wine from the truck. Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody of the petitioner,
Patna High Court CR. MISC. No.18181 of 2023(3) dt.18-05-2023 2/2 this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna City in connection with Agamkuan P.S. Case No. 574 of 2021.
This is also subject to the condition that the petitioner shall deposit an amount of Rs. 1 lakh in the Ram Krishna Mission, Ashram, Nala Road, Patna and will furnish the receipt of the same in the Court below.
The Special Judge will verify the deposit before accepting the bail bond and releasing the petitioner. (Sandeep Kumar, J) Guddu/- U T
