19-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Patliputra P.S. Case No. 121 of 2017 in Special Case No. 52/2017 registered for the offence punishable under Sections 3, 4, 5, 6 and 7 of Immoral Trafficking Act and Section 20 and 22 of the N.D.P.S. Act and Sections 467, 468, 420, 294 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that, so far as the present petitioner is concerned, he happened to be a Guard posted in the hotel, therefore, he has no role to play in the alleged occurrence or in the management of the hotel. Learned counsel submits that in fact the allegations would show that the hotel management along with one Poonam Bhatia was running the flesh trade. Learned counsel further submits that the
Patna High Court Cr.Misc. No.38606 of 2017 (2) dt.19-08-2017 hotel owners have been identified as one Pramod Kumar and Subodh Kumar who are said to be involved in this business along with Poonam Bhatia. It is further submitted that some of the co-accused similarly situated to the present petitioner have been granted privilege of regular bail in Cr. Misc. Nos. 28628/2017, 32514/2017 and 32355/2017.
Learned Additional Public Prosecutor opposes the prayer of bail of the petitioner but no distinction could be brought to the notice of the court in the case of the present petitioner.
Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, Patna, in connection with Patliputra P.S. Case No. 121/2017 in Special Case No. 52/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
