JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2017 The petitioner is in custody since 12.03.2017 in connection with Jehanabad P.S. Case No. 23 of 2017, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 20 litres of wine. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, there is allegation of recovery of only 20 litres of wine, for which petitioner has sufficiently been punished as he has been in judicial custody since 23.01.2017.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation coupled

Patna High Court Cr.Misc. No.32293 of 2017 (3) dt.25-07-2017 2/2 with the fact that petitioner is accused in two other similar type of cases, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected at this stage.

However, the trial court is directed to expedite the trial and try to conclude it within a period of four months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the court below itself.
