JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-04-2018 This has come under the heading 'To Be Mentioned' at the instance of learned counsel for the appellant for modification of order dated 14.3.2018.
Submission of learned counsel for the appellant is that some other order of other case has been typed in the said order and the appeal has been rejected and earlier prayer for bail of the appellant has been rejected in Cr.Appeal (SJ) No. 506 of 2017 and even charge has not been framed in this case till date. On perusal of record it appears that in this case some other order has been typed and earlier prayer for bail of the appellant has been rejected in Cr.Appeal(SJ) No. 506 of 2017 and learned trial court was directed to expedite the matter and at the same time S.P., Aurangabad was directed to ensure attendance of
Patna High Court CR. APP (SJ) No.250 of 2018 (5) dt.06-04-2018 2/2 the witnesses in court. It further appears from perusal of record that case of other accused has already been separated and trial has concluded leading to conviction of those accused persons and on appeal the other accused persons have been acquitted by this Court.
In such view of the matter, the order stands. However, in view of the fact that charge has not been framed in this case, learned trial court is directed to expedite the matter and hear the accused persons on charge and once charge has been framed learned trial court to expedite the matter.
Let this order be communicated to the court concerned forthwith.
