JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-05-2022 Heard learned advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in anticipation of his arrest in connection with Danapur P.S. Case No. 782 of 2018 dated 14.11.2018 instituted for the offences under Sections 147, 148, 149, 323, 341, 379, 324, 308 of the Indian Penal Code. Though the petitioner has been named in the F.I.R. but the specific act of assault has been attributed to others. It has also been submitted that there is a reason for falsely implicating the petitioner. About 40-50 persons have been made accused in this case but, in the absence of any specific accusation against the petitioner, it has been alleged that he deserves to be granted bail. It has also been submitted that the victim has received injury which has been opined to be simple in nature.

No.23893 of 2021(2) dt.24-05-2022 2/2 Considering the aforenoted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateI, Danapur, Patna in connection with Danapur P.S. Case No. 782 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
