JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 29-07-2015 The petitioner has renewed his prayer for anticipatory bail in connection with Baniyapur P.S. Case No. 64 of 2014 registered for the offences punishable under Sections 307, 323, 324, 341, 379, 504 and 506/34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.

The accusation against the petitioner and others is to have made assault with iron rod and Farsa to informant, his sister and brother.

It is submitted by learned counsel for the petitioner that the injury has been found to be simple. Considering the fact that earlier anticipatory bail application of the petitioner was disposed of with observation

Patna High Court Cr.Misc. No.18293 of 2015 (02) dt.29-07-2015 2/2 that the aforesaid facts constitute ground for consideration of regular bail, this Court is not inclined to revise the earlier order. Let the learned court below consider the prayer for regular bail of the petitioner, if he surrenders before the learned court below within a period of six weeks from today.
