Initially a proceeding at the behest of the petitioner was initiated under the Bihar Land Dispute Redressal Act bearing Land Dispute Redressal Case No. 32 of 2013 against the private respondent no. 4 for removal of encroachment from the private land of the petitioner.

Learned counsel for the petitioner submits that the D.C.L.R., Khagaria has passed the order on 18-11-2013 in the aforesaid case in favour of the petitioner for removal of encroachment. He further submits that against the order passed

Patna High Court CWJC No.6031 of 2020(2) dt.30-11-2021 2/2 by the learned D.C.L.R., Khagaria, the respondent no. 4 has preferred appeal bearing B.L.D.R. Appeal No. 17 of 2014 before the Divisional Commissioner, Munger and since 2014 almost seven years have elapsed but the appeal has not yet been decided by the Divisional Commissioner, Munger. Mr. Dhurjatti Kumar Prasad, learned counsel for the State submits that a reasonable time may be given for disposal of the appeal by the Divisional Commissioner, Munger in accordance with law.

In view of the submissions made by the parties, the Divisional Commissioner, Munger is directed to dispose of the B.L.D.R. Appeal No. 17 of 2014 pending before him within a period of four months from the date of receipt / production of a copy of this order.

With the aforesaid observation and direction, this writ petition is disposed of.
