JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-02-2023 Heard learned counsel for the petitioner as well as Mr. Shailendra Kumar, the learned APP for the State. The petitioner apprehends his arrest in connection with Agamkuan P.S. Case No. 177 of 2018, registered for the offences punishable under Sections 406, 420, 467, 468d, 471 of the Indian Penal Code.

There is allegation that the petitioner had taken Rs. 12 lacs from the informant and other persons, and issued a forged certificate relating to Nursing and Dresser. Meanwhile, those certificates were found forged. Thereafter, the petitioner had absconded and he is traceless.

At the very outset, the learned APP, Sri Shailendra Kumar has submitted that paragraph nos. 83 and 92 reveals that

Patna High Court CR. MISC. No.23526 of 2021(4) dt.02-02-2023 2/2 process under Section 82 and 83 have been issued and the petitioner has been declared as proclaimed offender. In view of aforesaid submission, this application is rejected, in the light of the recent decision in the case of Prem Shankar Prasad vs. State of Bihar and Another (2021 SCC online SC 955). Accordingly, it is rejected.
