The petitioner apprehends his arrest in a case registered for the offence under Section 363, 366(A) read with Section 34 of the Indian Penal Code.
As per the prosecution case, this petitioner alongwith other accused persons riding on a motorcycle forcibly took away daughter of the informant with intention to marry her. It is submitted on behalf of petitioner that the victim girl, in her statement recorded under Section 164 Cr.P.C., has not alleged that this petitioner has committed any sexual misconduct with her. It is further submitted that the matter has been compromised between the parties and to this effect, a joint compromise petition has already been filed before the learned court below (Annexure 5 to the supplementary affidavit). Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.14978 of 2022(4) dt.10-11-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the fact that in the statement recorded under Section 164 Cr.P.C., the victim has not alleged any sexual misconduct or ill-treatment against this petitioner as also the fact that petitioner has got clean antecedent, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali in connection with Rajaparkar P.S. Case No. 159 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
