The petitioner apprehends his arrest in Kochadhaman P.S. Case no. 54 of 2014, registered for the offences punishable under Section 409 and other Sections of the Indian Penal Code. The gist of the allegation is that the Panchayat Sewak, Mukhiya and others including the petitioner (Junior Engineer) prepared wrong muster roll of labours working in MANREGA. It is submitted that the petitioner is a Junior Engineer and he is not Incharge of the Panchayat.

It is submitted that Dinesh Kumar Ganesh, Panchayat Rojgar Sewak and Imteyaz Ahmad, Panchayat Technical Assistant have already been granted anticipatory bail vide order passed in

Patna High Court Cr.Misc. No.16504 of 2015 (2) dt.30-04-2015 2/2 Cr. Misc. no. 49865 of 2014 and Cr. Misc. no. 44083 of 2014. The money which are alleged to have been withdrawn has already been deposited.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kochadhaman P.S. Case No. 54 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
