JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

It is alleged that on the request of the petitioner the informant allowed her daughter Rani Kumari to go to the house of the petitioner and thereafter she went traceless. It is submitted by the learned counsel for the petitioner that though the victim in her 164 Cr.P.C. statement got her age recorded as 14 years whereas the court assessed her age as 16 years where she stated that after a tiff with sister in law (Bhabhi), she went to her maternal uncle's house at Ludhiana and thereafter

Patna High Court Cr.Misc. No.17471 of 2015 (2) dt.14-05-2015 2/2 she returned on the direction of maternal uncle and aunt and was never kidnapped. It is further submitted that the victim has not named the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 212 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
