Petitioner, already in custody, seeks bail in connection with Shikarpur P.S. Case No.459 of 2017, registered under Sections 20, 22 and 23 of the NDPS Act.

Allegation in brief is that 10.4 Kgs. of Charas was recovered from possession of one Akhilesh Mahto carrying Charas in a bag while travelling in a bus.

Learned counsel for the petitioner submits that the recovery is from possession of Akhilesh Mahto and not from this petitioner, the petitioner was also not in the bus, after two days of the arrest of Akhilesh Mahto, he stated in the confessional statement that the bag was handed over to him by this petitioner and except that there is no other material against

Having considered the said facts and circumstances, petitioner Balister Mian @ Balister Miyan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bettiah, West Champaran in connection with Shikarpur P.S.
