2. Petitioner seeks regular bail in connection with Raniganj P. S. Case No. 355 of 2025 registered for the offences punishable under Sections 105 and 3(5) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, on 15.09.2025 at about 2 PM, when the informant was installing electric pole, in the meantime, this petitioner, along with co-accused person, came and scuffled with the informant. It is further alleged that during course of scuffle, this petitioner and co-accused Awadhesh Kumar Singh pushed the father of informant as a result of which, he fell down and succumbed to the injuries.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.13591 of 2026(2) dt.03-04-2026 2/2 petitioner is innocent and has committed no offence. Allegation against petitioner is general and omnibus. It is a case of accidental death. As a matter of fact, in course of scuffle, father of informant fell down, sustained injuries and died. Co-accused Awadhesh Kumar Singh has already been granted anticipatory bail by this court vide order dated 03.02.2026 passed in Cr. Misc. No. 5405 of 2026. Petitioner claims clean antecedent and is in custody since 03.12.2025.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Araria in connection with Raniganj P.
