JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 39 of 2017, registered under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is that on receiving secret information about gathering of the criminals for committing dacoity, the Police reached at orchard of one Gopal Roy, where five persons including the petitioner apprehended. On search, one country made pistol along with 10 live cartridges were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.25506 of 2017 (3) dt.05-07-2017 2/2 petitioner is in custody in the present case since 08.02.2017. Further submission is that though the petitioner is accused in five cases, as detailed in para-5 of the Supplementary Affidavit, but all the cases are of the year 2006.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Bhagalpur in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 39 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
