1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Nimchak Bathani P.S. Case no. 93 of 2023 registered under sections 307, 147, 148, 149, 323, 341, 504, 506 and 379 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the five named accused persons including the petitioner herein came variously armed. On being asked by the informant not to carry out the illegal mining of sand, it is stated that the accused persons started to abuse and assault the informant. It is further stated that Arun Yadav assaulted the informant with iron rod on his head causing grievous injuries.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the

Patna High Court CR. MISC. No.20101 of 2024(2) dt.02-04-2024 2/2 case. The allegations even as per the FIR are general and omnibus in nature. The petitioner is in custody since 3.12.2023 and chargesheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P. for the State who submits that the petitioner has several antecedents.

6. Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation against the petitioner in the F.I.R., his being in custody since 3.12.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Nimchak Bathani P.S. Case no. 93 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya.
