Considering the facts stated in the written report of the informant indicating as if her husband had forcibly been taken away by the accused persons who were led by the present petitioner, the court is not inclined to consider the compromise petition so as to granting bail under Section 438(2) Cr.P.C. Petition is dismissed.

Let the petitioner, however, surrender in the court below, i.e., CJM, Sheikhpura in connection with Sheikhpura (Kushumbha) P.S.Case No.363 of 2014 who shall consider the prayer for bail on its own merit without being influenced by any order of rejection under Section 438 Cr.P.C.
