The petitioner seeks bail in Naubatpur P.S. Case No. 457/2018, instituted for offence under Section(s) 25(1-b)A, 26 and 35 of the Arms Act.

It is alleged in the written report that on getting secret information, police party reached at the place of occurrence and intercepted two persons, who were riding over Apachi Motorcycle in drunken condition. From possession of petitioner one loaded country made Katta was recovered.

Learned counsel for the petitioner has submitted that petitioner was pillion rider of the aforesaid motorcycle. The other co-accused, who was driving the motorcycle, has already been granted bail by a Co-ordinate Bench of this Court in Cr.

Patna High Court CR. MISC. No.13580 of 2019(2) dt.06-03-2019 2/2 Misc. No. 10286/2019 dated 20.02.2019.

Petitioner is in custody since 08.10.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IInd, Danapur, Patna, in connection with Naubatpur P.S. Case No. 457/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
